These Terms of Service (“Terms”) govern your use of the website https://obermajer.co.uk (the “Site”) and any related tools, downloads, datasets, CAD files, maps, or services provided through it (together, the “Services”).

The Services are operated by Obermajer Ltd (“we”, “us”, “our”). Registered in England and Wales, company number 17441258. Registered office: 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ.

2. Acceptance of These Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

3. Our Services

We provide access to mapping data, CAD files, and related technical information. The Services may include free and paid downloads.

The Services are provided for information and technical use only. They do not constitute professional advice.

The Data made available through the Services may consist of copies, extracts, transformations, or representations of original datasets provided under their respective licences. We do not represent that the Data is authoritative, definitive, complete, current, or identical to the original source material.

The Services are intended for customers based in the United Kingdom only.

4. Licence to Use Data and CAD Files

4.1 Licence Grant

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable licence to download and use files and data made available through the Services (“Data”).

Unless stated otherwise on the Site, you may use the Data for:

  • personal use
  • academic or research use
  • internal business use
  • commercial projects where the Data is used as an input, not resold as-is

4.2 Restrictions

You must not:

  • resell, redistribute, sublicense, or make the Data available to third parties as a standalone product
  • publish the raw Data on another platform
  • use the Data to create a competing data service
  • remove copyright, attribution, or licence notices
  • imply endorsement by us or by original data providers

Derived works, including drawings, models and analyses, may be created and shared as part of a project, provided the underlying raw Data is not redistributed as a standalone dataset.

4.3 Third-Party Data Sources

Some Data may originate from third parties (for example public authorities). Additional licence terms or attribution requirements may apply. You are responsible for complying with those terms.

4.4 Bulk Downloading, Mirroring, and Dataset Copying

Except where expressly permitted by us in writing, you must not download, copy, extract, cache, mirror, reproduce, or store substantial parts of the Data or Services.

You must not use the Services to build, recreate, reverse engineer, derive, compile, or maintain a separate database, dataset, archive, mirror, copy, substitute service, or competing product based on the Data or any substantial part of it.

You must not systematically download files or attempt to obtain all or a substantial proportion of the Data made available through the Services, including by spreading activity across multiple accounts, email addresses, IP addresses, devices, organisations, or payment methods.

Access to individual files is provided for genuine project, site-specific, technical, research, or internal business use. It is not a licence to harvest the Services or copy the underlying dataset.

5. Intellectual Property

All rights in the Site, software, branding, layout, text, and original content are owned by or licensed to us.

Nothing in these Terms transfers ownership of any intellectual property to you.

6. User Conduct

You agree not to:

  • use the Services unlawfully
  • interfere with the operation or security of the Site
  • attempt to scrape, harvest, or extract data by automated means
  • reverse engineer or attempt to bypass technical restrictions
  • use scripts, bots, crawlers, scrapers, automated tools, download managers, or similar methods to access, copy, or download Data
  • mass download, bulk export, harvest, mirror, cache, copy, or reconstruct the Data or any substantial part of it
  • create, use, or control multiple accounts to avoid download limits, suspensions, blocks, pricing, technical restrictions, or these Terms
  • share accounts, login links, and access credentials with third parties
  • attempt to disguise, rotate, or misrepresent your identity, location, IP address, device, organisation, or purpose
  • continue accessing the Services after your account, email address, IP address, organisation, or other access method has been suspended or blocked

We reserve the right to suspend or block access for misuse.

7. Subscriptions and Payments

We offer a free plan and paid subscriptions. Standard paid subscriptions renew monthly until cancelled. Business customers, including those with multiple seats, may have separate pricing and payment arrangements agreed in writing.

Online payments are processed by Stripe. Business arrangements may also be invoiced and paid outside Stripe.

Where applicable, paid access is licensed per user/seat, and the account-sharing restrictions in section 6 apply to all subscriptions and seats.

You can cancel a monthly subscription in Settings/Account or by emailing info@obermajer.co.uk before your next renewal. Cancellation stops future renewals, and access continues until the end of the paid billing period. This does not limit any statutory right to cancel earlier or receive a refund.

Refunds are provided where required by law and may otherwise be issued at Obermajer Ltd’s discretion.

All plans are subject to fair use and the restrictions on bulk extraction, automation, account sharing and dataset copying in sections 4.4 and 6. Use must relate to specific projects and be reasonable and proportionate to the needs of those projects. Use intended to obtain, reconstruct or compile substantial areas or datasets is not permitted. We may restrict excessive or abusive use where necessary to protect the Services.

8. Availability and Changes

We may change prices, plans and features to reflect changes in costs, data availability or legal and technical requirements. For existing paid subscriptions, price increases or material reductions in access or features take effect at a renewal with at least one month’s email notice. You can cancel before the changes take effect.

We do not guarantee uninterrupted availability.

9. No Professional Advice

The Services may include technical, engineering, mapping, or planning-related information.

All Data is provided for general information and reference purposes only.

Nothing provided through the Services constitutes professional, legal, engineering, surveying, planning, or other regulated advice.

You must not rely on the Services as a substitute for independent professional judgment.

You are solely responsible for verifying accuracy, completeness, suitability, and compliance with applicable laws, standards, site conditions, and project requirements before any use.

10. Disclaimer

The Services and all Data are provided “as is” and “as available”.

The Data may be incomplete, simplified, generalised, outdated, or subject to errors or omissions.

To the fullest extent permitted by law, we disclaim all warranties, including accuracy, completeness, fitness for purpose, and non-infringement.

Use of the Services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for:

  • indirect or consequential losses
  • loss of profits, data, or business
  • errors or omissions in the Data
  • decisions or actions taken based on the Services

Subject to the above, our total liability arising from the Services shall not exceed the lesser of £100 or the amount paid by you for the relevant Services during the previous 12 months.

Nothing in these Terms limits liability that cannot be excluded under UK law.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from:

  • your use of the Services
  • your breach of these Terms
  • your misuse or redistribution of Data

13. Privacy

This section explains how we collect and use personal data when you use the Services. Obermajer Ltd is the data controller responsible for this personal data.

13.1 Personal Data We Collect

We collect only the minimum personal data necessary to operate the Services.

  • Account email address and login/activity data
  • Technical logs, such as IP address, timestamps, and basic request metadata
  • Platform usage and download activity
  • Subscription and payment status, and Stripe customer and subscription identifiers

13.2 How We Use Personal Data

We use personal data only to:

  • authenticate users and provide account access
  • administer subscriptions, payments and billing communications
  • operate and secure the Services
  • monitor usage for technical and performance purposes
  • enforce plan usage limits and prevent misuse

We do not use personal data for marketing purposes.

You have the right to complain to the Information Commissioner’s Office about our use of your personal data.

13.3 Legal Basis

Our legal basis for processing personal data is:

  • performance of a contract (providing access and administering subscriptions and payments)
  • legitimate interests in operating and securing the Services and preventing misuse

13.4 Data Retention

We retain personal data only for as long as necessary to provide the Services and meet legal or operational requirements.

13.5 Data Sharing

We do not sell personal data.

We may share limited personal data with trusted service providers who help us operate the Services (for example email delivery or hosting providers), strictly for that purpose and subject to appropriate safeguards. These include Stripe for payment processing and subscription management, Resend for email delivery, and Cloudflare for hosting, content delivery and security.

13.6 Cookies

The Services use only essential/functional cookies required to operate the platform.

We do not use advertising, marketing or tracking cookies.

Under UK data protection law, you have rights including the right to access, correct, or request deletion of your personal data.

14. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms.

Termination does not affect accrued rights or obligations.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction over any disputes arising from these Terms or the Services.

16. Changes to These Terms

We may update these Terms from time to time.

For existing subscriptions, material changes will be notified by email at least one month in advance and take effect at a renewal after that notice period. You can cancel before they take effect. Urgent changes required by law or security may take effect sooner, with notice as soon as reasonably possible.
